Terms of Service
These terms govern the relationship between Morsapp Bilişim Teknolojileri Yaz. Don. Bilg. Tic. A.Ş. ("MorsApp", "we") and the business using the MorsApp service ("Merchant", "you"). By opening an account, starting a free trial or using the service, you accept these terms and our Privacy Policy. If you accept on behalf of a business, you confirm that you are authorized to bind it.
1. The service
MorsApp is cloud software providing an online store, B2B dealer portal, product and order management, marketplace and ERP connections, customer conversations over Facebook, Instagram, Messenger and WhatsApp, and AI tools. Package contents are described on the Pricing page. The service is intended for businesses and may not be used as a consumer.
2. Account and security
- Keep your registration details accurate and up to date.
- You are responsible for protecting your login credentials and for deciding who can access the dashboard and with which permissions.
- Tell us immediately at info@morsapp.io if you notice any unauthorized use of your account.
3. Free trial
- The trial starts when your store setup is completed and lasts one calendar month. The end date is shown after sign-up and in your account email.
- No credit card is requested and no automatic charge is started; a paid package is never purchased automatically through sign-up.
- The starter theme and sample products are for getting to know the system. Remove sample products and complete your own product, price, stock, domain, payment and shipping details before selling.
- Central AI access during the trial is limited to one calendar month, and quotas are shown in the dashboard.
4. Fees and payment
Prices for paid packages are listed on the Pricing page and exclude VAT unless stated otherwise. The scope and price of campaigns, custom development and ERP integrations are agreed separately in writing. If a payment is overdue, the service may be suspended after written notice.
5. Acceptable use
You may not use MorsApp to:
- sell illegal, counterfeit or prohibited goods or services;
- send commercial messages without the recipient's consent (spam), or breach Turkish Law No. 6563 and the Message Management System (IYS) rules;
- collect, process or share other people's personal data unlawfully;
- attempt unauthorized access, bypass security measures, overload the service or reverse-engineer it;
- publish misleading, hateful or infringing content.
6. Facebook, Instagram, Messenger and WhatsApp connections
- You may only connect Facebook Pages, Instagram professional accounts and WhatsApp Business accounts that you are authorized to manage.
- When using these channels you must comply with the Meta Platform Terms, Meta Community Standards, Messenger and Instagram messaging policies, and the WhatsApp Business and Commerce Policies. For example, on Messenger, messages may be sent more than 24 hours after the customer's last message only where Meta allows it.
- You are the controller of customer data obtained through messages and comments; informing your customers and obtaining any required consent is your responsibility.
- You can disconnect a channel from the dashboard at any time. Doing so deletes the stored access tokens; to delete the data itself, see the Data Deletion Instructions.
- MorsApp is not responsible for these channels not working due to changes, restrictions or outages in Meta's own services.
7. Your data and content
Product, image, customer, order and message data you upload belongs to you. We process it only to provide, back up and secure the service; see the Privacy Policy for details. For your customers' personal data you are the controller and we are your processor. You confirm that your content is lawful and does not infringe third-party rights.
8. AI tools
AI output is generated automatically and may contain errors. You are responsible for reviewing output such as product descriptions, customer replies, images or posts before publishing. On channels where you enable automatic replies, replies are sent on your behalf. Action drafts are applied only when an authorized user approves them.
9. Intellectual property
The MorsApp software, design, themes and brand belong to MorsApp. During your subscription you receive a non-transferable, non-exclusive right to use the service.
10. Availability and liability
We take reasonable care to keep the service available and error-free, but interruptions may occur due to maintenance, third-party services (payment institutions, marketplaces, Meta, ERP, hosting) or force majeure. Except where liability cannot be limited by law, our liability is limited to the fees you paid us in the 12 months before the event giving rise to the claim, and we are not liable for indirect damages or loss of profit or data.
11. Termination
- You may close your account at any time.
- We may suspend or close an account for material breach of these terms or unlawful use.
- If you ask within 30 days of closure, we will help you export your data; after that period data is deleted, except where we must retain it by law.
12. Changes
We may update these terms. We announce material changes by email or in the dashboard before they take effect; continuing to use the service afterwards means you accept the updated terms.
13. Governing law
These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Konya (Central) have jurisdiction over disputes.
